Counter-Notification Procedure

If you believe that your material was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with our Copyright Agent. Your counter-notification must include the following:

  1. Identification of the Material: A description of the material that has been removed or to which access has been disabled, including the URL or other specific location on the Site where the material appeared before it was removed or disabled.
  2. Your Contact Information: Your name, address, telephone number, and email address.
  3. Statement of Consent: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Thelisto may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  4. Statement of Good Faith: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  5. Signature: A physical or electronic signature.

Handling of DMCA Notices

  • Review and Action: Upon receiving a valid DMCA Takedown Notice, we will promptly review the complaint and remove or disable access to the allegedly infringing material. We will also notify the user who posted the material of the takedown.
  • Counter-Notifications: If we receive a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a lawsuit within 10 business days, we will restore the material in question.
